Welcome to The Other Sports, a software-as-a-service platform provided by The Other Sports, Inc, available at https://theothersports.com and https://theothersports.al (together, the “Websites”). These Terms and Conditions (“Terms”) govern your use of our websites, platform, and services (collectively, the “Services”). By accessing or using The Other Sports, you agree to these Terms. If you do not agree with these Terms, you must not use the Services.
By using our Services, you confirm that you are at least 14 years old. Only athletes aged 14 or older may create or claim a profile. If you are under 18, you represent that you have the permission of a parent or legal guardian to use the Services. If you are entering into these Terms on behalf of an organization (e.g., a school, club, or business), you represent that you have authority to bind that entity to these Terms.
We may create initial athlete profiles by seeding publicly available competition results and other sources of sports data. These profiles may contain errors or omissions. Athletes or their parents/guardians may claim or create profiles and update or correct information, including event times and biographical details.
We strive for accuracy but do not guarantee that any data or times are complete or correct. It is the responsibility of the athlete or guardian to review and correct the information in their profile. The Other Sports is not liable for inaccuracies.
Athletes may upload a profile image and other content. You represent that you have all necessary rights to such content and that it does not infringe any third-party rights or violate any law. By uploading, you grant The Other Sports, Inc a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and otherwise use the content solely to operate and provide the Services. We may remove content that is inappropriate, unlawful, or infringes rights at our discretion.
Athletes may opt in to share their contact information and “About Me” profile details with verified college coaches and/or NIL brand sponsors. If you opt in, that information will be visible to authorized third parties using the Services.
College coaches and NIL brand sponsors may use shared information for recruiting, sponsorship, or related purposes. The Other Sports does not control and is not responsible for third-party actions once information is shared at your direction. For details on how we collect, use, and protect personal information—and how to exercise privacy rights, including deletion—please review our Privacy Policy. See also Section 15 (Profile Removal and Data Deletion).
All platform software, rankings, analytics, and other information provided through the Services are the property of The Other Sports, Inc. We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, educational, or organizational purposes in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from our software, data, rankings, or analytics without our prior written consent.
The Other Sports operates on a tiered subscription model. By subscribing, you agree to pay the fees associated with your chosen plan. Subscription fees are charged on a recurring basis as specified during signup. Plan features and limits may vary by tier.
Fees are exclusive of applicable taxes, which you are responsible for paying. We may change plan prices and features prospectively by posting updated information or providing notice as required by law.
Refunds are available only if requested within 24 hours of the charge being posted. After this period, all charges are non-refundable. To request a refund, contact support@theothersports.com with your payment details and reason for the request.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access at support@theothersports.com.
We may modify, suspend, or discontinue the Services (or any part of them) at any time with or without notice. The Other Sports is not liable for any disruption or loss caused by such modifications.
The Services are provided “as is” and “as available,” without any warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Rankings and Analytics Disclaimer. Rankings, ratings, and analytics are opinions and estimates based on available data and methodologies that may change over time. They are provided for informational purposes only and are not guarantees of future performance or outcomes.
To the fullest extent permitted by law, The Other Sports, Inc shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Services, even if advised of the possibility of such damages.
We may suspend or terminate your access to the Services at any time, with or without cause, and without prior notice. If your account is terminated, you remain bound by these Terms for any prior use of the Services.
These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles.
We may update or modify these Terms at any time. Changes are effective when posted on the Websites. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

Athletes (or their parent/guardian if under 18) may request that The Other Sports delete their profile and associated personal information. Upon receiving such a request at support@theothersports.com, we will take reasonable steps to remove the profile and associated information from our Services, subject to any legal or regulatory obligations to retain certain data.
By using The Other Sports, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
